The Board for Geologists and Geophysicists (Board) issued a Citation and Fine of $500 on March 28, 2006, to Mr. Jon Lovegreen, Professional Geologist (PG) No. 3726 and Certified Engineering Geologist No. 1164, for violation of section 7872(e) of the Geologist and Geophysicist Act (practicing geology with an expired license). The fine amount was reduced to $250 on April 1, 2006 due to mitigating factors.
Mr. Lovegreen submitted a permit application titled "Subsurface Drilling Application" (Permit Application), signed as "Jon R. Lovegreen, CEG No. 1164" to the San Mateo County Environmental Health Department on January 31, 2006. At the time of the Permit Application submittal to San Mateo County, Mr. Lovegreen's PG license had been expired for 7 months. On February 8, 2006, Mr. Lovegreen renewed his PG license No. 3726 and CEG license No. 1164 and is now in compliance with the Geologist and Geophysicist Act. However, at the time of the Permit Application submittal, Mr. Lovegreen was not licensed to practice geology or to offer to practice geology for others in the State of California.
Section 125.9(d) of the Business and Professions Code which specifies that payment of the fine does not constitute admission of the violation charged and represents satisfactory resolution of the matter. Mr. Lovegreen agreed to pay the fine and the case was closed on May 10, 2006.
