David Sanders
Professional Geologist No. 2728
The Board for Geologists and Geophysicists (Board) issued a Citation and Fine of $2,500 on March 7, 2006, to Mr. David Sanders, Professional Geologist (PG) No. 2728 for violation of sections 7872(a) and 7872(e) of the Geologist and Geophysicist Act. The citation was issued for practicing geology with an expired license. The fine amount was reduced to $2,000 on April 12, 2006 due to mitigating factors.
Mr. Sanders submitted a permit application titled "Project Description and Appendices to an Application for Use Permits Covering: (1) An Equestrian Center, and (2) The Re-Activation of Surface Mining and Rock and Mineral Processing South Arkansas Creek Project Amador County," (Permit Application), signed as "David Sanders, Agent for Process" to the Amador County Environmental Health Department on August 30, 2005. At the time of the Permit Application submittal to Amador County, Mr. Sanders PG license had been expired for 34 months. On November 30, 2005, Mr. Sanders renewed his PG license No. 2728 and is now in compliance with the Geologist and Geophysicist Act. However, at the time of the Permit Application submittal, Mr. Sanders was not licensed to practice geology or to offer to practice geology for others in the State of California.
Section 125.9(d) of the Business and Professions Code which specifies that payment of the fine does not constitute admission of the violation charged and represents satisfactory resolution of the matter. Mr. Sanders agreed to pay that fine and the case was closed on April 13, 2006.
